The Website is operated by John Stewart Adams, Sales Representative with Chestnut Park Real Estate Limited, Brokerage (“John,” “we,” “us” or “our”).

By accessing or using the Website, you agree to these Terms of Use. If you do not agree, please do not use the Website.

2. General Information Only

Website content is provided for general informational and marketing purposes. It is not legal, financial, tax, mortgage, insurance, appraisal, inspection or other professional advice.

Real estate circumstances differ, and information may become outdated. You should obtain advice from appropriately qualified professionals before acting on Website information.

3. No Agency or Client Relationship

Visiting the Website, using a calculator or search feature, communicating through chat, submitting a form or receiving general information does not by itself create a client, agency, representation, fiduciary or other professional relationship with John or Chestnut Park Real Estate Limited, Brokerage.

Any real estate representation relationship must be established separately in accordance with applicable law and brokerage requirements.

4. Accuracy and Availability

We make reasonable efforts to provide useful and current information, but we do not warrant that Website content, property information, market data, automated responses or third-party information is complete, accurate, current or error-free.

The Website and any feature may be changed, suspended or unavailable without notice. Property availability, prices, descriptions, measurements, taxes and other details may change and must be independently verified.

5. Property Listings and CREA DDF®/IDX Content

Some property information displayed on the Website may be provided through The Canadian Real Estate Association (“CREA”), a real estate board, a brokerage, an IDX provider, a DDF® provider or another third party.

Listing information is intended solely for the private, non-commercial use of individuals seeking information about real estate. It may not be copied, republished, redistributed, scraped, mined, reorganized, sold or used to create a database or mailing list.

Listings may already have been sold, leased, withdrawn or otherwise be unavailable. Information should be independently verified before being relied upon.

Required CREA Statement

REALTOR®, REALTORS®, and the REALTOR® logo are certification marks that are owned by REALTOR® Canada Inc. and licensed exclusively to The Canadian Real Estate Association (CREA). These certification marks identify real estate professionals who are members of CREA and who must abide by CREA’s By-Laws, Rules, and the REALTOR® Code. The MLS® trademark and the MLS® logo are owned by CREA and identify the quality of services provided by real estate professionals who are members of CREA.

Submitting a form or requesting an appointment does not guarantee availability, acceptance of instructions, representation or the provision of any service. An appointment is not confirmed until confirmation is provided through the booking system or directly by John.

You agree that information you submit will be accurate and that you will not impersonate another person or submit information without authority.

9. Acceptable Use

You may not:

• use the Website for unlawful, fraudulent or abusive purposes;
• attempt to gain unauthorized access to the Website or connected systems;
• interfere with Website operation or security;
• introduce malicious code or automated traffic;
• scrape, harvest or systematically collect Website or listing content;
• use Website content to create or enhance a competing listing database; or

10. Intellectual Property

Unless otherwise indicated, Website text, design, graphics, branding, photographs and other original content are owned by or licensed to John, the brokerage or their respective providers and are protected by intellectual-property laws.

You may view Website content for personal, non-commercial purposes. No other right or licence is granted. Third-party names, logos and trademarks remain the property of their respective owners.

The Website may link to or embed third-party property searches, maps, videos, calendars, social networks and other services. These are provided for convenience. We do not control and are not responsible for their availability, security, accuracy, content, policies or practices.

Your use of a third-party service is governed by that provider’s terms and privacy policy.

If you request information or submit an inquiry, you authorize us to respond using the contact information provided.

Marketing emails and text messages will be sent only where permitted by law. You may unsubscribe from marketing communications at any time. Transactional, service-related or legally required messages may still be sent where appropriate.

Nothing in these Terms limits liability where doing so is prohibited by law.

15. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless John and Chestnut Park Real Estate Limited, Brokerage from claims, liabilities, losses and reasonable costs arising from your unlawful use of the Website, your violation of these Terms or your infringement of another person’s rights.

16. Governing Law

These Terms are governed by the laws of Ontario and the federal laws of Canada applicable in Ontario. Subject to any rights you may have under applicable consumer-protection law, disputes relating to the Website will be submitted to the courts of Ontario.

17. Changes to These Terms

We may update these Terms from time to time. The revised Terms will be posted on this page with an updated effective date. Continued use of the Website after an update constitutes acceptance of the revised Terms.
